Second-degree murder charges dropped, brother now charged with manslaughter

One released, as reduced case for brother in Sackville stabbing to return to court in May

Just a few days after two Sackville brothers were charged with murder, the Crown has reduced charges against one accused and abandoned the case against the other.

Tyler Murphy, 22, and Dylan Murphy, 20, had appeared in Moncton provincial court on March 19 after being charged with second-degree murder in the death of 44-year-old Shawn Mitton in Sackville on March 16. Both men asked for time to get legal aid and they returned to court on Wednesday with defence lawyers.

Before the defence could make any requests, the prosecutor indicated charges of murder were being withdrawn. Dylan Murphy now faces no charge and was ordered released by the court while Tyler Murphy was charged with manslaughter.

His lawyer asked for more time to get the Crown’s evidence and review it, so the case was set over to May 13.

The RCMP said in a news release at the time that officer responded to a report of a stabbing outside of a business on Lorne Street in Sackville. When police arrived, they found a man lying on the side of the road suffering from stab wounds.

He was transported to hospital where he later died from his injuries.
