Stolen ATV results in discharge

SUSSEX - Mark Anthony Buchanan, 21, of Sussex was found guilty of the possession of stolen property during his brief trial in Sussex provincial court on Friday.

He was charged after Sussex RCMP pulled him over for an ATV driving violation in May and noted damages done to the vehicle's ignition and part of its serial number scratched off. The vehicle had been stolen from Saint John and recovered with that arrest in Four Corners near Sussex.

In Buchanan's possession was a 1998 Honda Sierra X250. Despite the accused saying he purchased the vehicle for $300, Judge Henrik Tonning found him guilty of possessing the ATV on that date after Crown prosecutor John Henheffer and defence lawyer David Lutz agreed on the statement of facts.

Buchanan, who had no prior criminal record, received a six-month conditional discharge with the only condition to keep the peace and be of good behaviour. He also paid a $50 victim fine surcharge.

This will deter people from buying a stolen ATV.The kid obviously knew it was stolen with damages to the ignition and a scratched serial number.

The judge should have at least made him pay the ATV's worth to the proper owner. People who buy stolen property are just as guilty as those who steal it!!!!!
