Smashed ex-girlfriend's computer

ST. STEPHEN - After he was dumped by his girlfriend, a Blacks Harbour man broke the frame of her door and smashed her computer screen, a Crown prosecutor said.

Calvin Llewellyn Kernighan, 32, of Blacks Harbour, pleaded guilty to mischief and uttering a threat and was in St. Stephen provincial court Tuesday for sentencing.

Judge David Walker handed down a suspended sentence that included a one-year supervised probation order requiring him to keep the peace and be of good behaviour. The judge also ordered him to have no contact with the victim, attend an anger management course and participate in any other programs recommended by his supervisor. Walker also ordered Kernighan to pay the victim $600 to replace the laptop computer he broke.

Crown prosecutor Randy DiPaolo said Kernighan's girlfriend told him on July 25 that she didn't want their relationship to continue. DiPaolo said he didn't take the news very well and went back to the house later in the day. He said Kernighan forced a door open causing the frame to break, smashed her computer screen and threatened to hurt her.

DiPaolo told the court Kernighan has tried to contact the victim via MSN, an online messaging service, and has sometimes made inappropriate comments. DiPaolo said the victim has a new man in her life and does not want Kernighan to have any contact with her.

DiPaolo suggested a third party should act as mediator to arrange visits with their child.

Duty counsel lawyer Randall Wilson said Kernighan is sorry and is prepared to make restitution for the damage he caused.

"He never intended to hurt her and he never actually did hurt her," Wilson said.

Walker told Kernighan it is important that he not make contact with the victim.

"It's unfortunate that she has moved beyond the relationship with you and you have difficulty with that," Walker said.

"Not anymore," Kernighan replied.
