Customs Act charge laid

The Canadian Border Service Agency's investigations division charged two men on Tuesday with acting together to import a prohibited weapon, contrary to Section 135 of the Federal Customs Act. Scott Michael Crain, 18, of Winslow Street West, entered a not guilty plea, while Christopher Lee Mattatall, 20, of the Gowan Road in Bocabec, entered no plea. That matter, as well as others involving the pair, were adjourned until 10 a.m. on July 23 by provincial court Judge Andrew LeMesurier. Mattatall did enter a trio of not guilty pleas Tuesday on Criminal Code charges of possessing a restricted firearm on May 21; possession of a concealed weapon, a baton, last Oct. 24; and violating probation on May 21.

Federal parolee given 30 days

SAINT JOHN - A federal parolee who didn't return to the Parrtown Centre by curfew on Feb. 17 not only had his parole revoked, but also got more jail time. On Tuesday, provincial court Judge Andrew LeMesurier sentenced Shane Lee Croke, 20, to serve 30 days in jail in addition to any time he is now serving. Croke pleaded guilty to being unlawfully at large. The court heard he had been apprehended by police in the Halifax area in April.

Remanded until July 28

SAINT JOHN - Referring to a dispute over visitation rights between Travis Earl Boudreau, 20, of Alpha Place, and the mother of their child as "a very volatile, serious" matter, provincial court Judge Andrew LeMesurier remanded the convicted man to jail on Monday to allow for the woman to file a victim impact statement with the court before his sentencing on July 28. Boudreau had entered guilty pleas to a single charge of violating a court order not to be in contact with the woman or be at her residence on several occasions between May 17 and June 27, as well as a second count of possessing a prohibited weapon, brass knuckles, on June 28. After hearing of how the woman complained Boudreau had made threats to her, and does not want him to see her or the child, duty counsel Margaret Gallagher suggested the issue of child custody was a matter for Family Court, not the mother, and is one that should be dispensed of quickly in order to diffuse the situation.

Mom defrauds government

SAINT JOHN - Shawna Erin Clark, a 28-year-old mother of three with no prior record, was found guilty in provincial court of defrauding Family and Community Services of $9,712. Clark was entitled to the money, but she also had a job and didn't declare the income. She pleaded guilty and will be sentenced on July 30.

Found guilty, fined $1,955

SAINT JOHN - Marie J. Wells, 61, of Ludlow Street was fined a total of $1,700 and ordered to pay victim fine surcharges amounting to $255 after being found guilty at trial of refusing to take a breathalyzer test and leaving the scene of an accident last Dec. 8. Provincial court Judge Alfred Brien granted a stay of proceedings on a third charge.
