Man must leave if girlfriend says

ST. STEPHEN - Provincial court Judge David Walker granted a Campobello woman a lever to control the behaviour of her common-law partner.

The judge included a term in a probation order allowing Dustin Lawrence Flynn, 21, of Campobello Island "to be in her presence if she permits you." He must leave if asked.

Flynn pleaded guilty to possession of oxycodone on July 5.

The RCMP laid the charge after recovering three Percocet pills from Flynn's shoe at Wilson's Beach. He came to court also for sentencing for a charge of assault that the judge described as "minor," as well as attempting to sell a television that belonged to someone else.

For the assault, Walker placed Flynn on probation for a year with conditions requiring that he keep the peace and be of good behaviour, abstain from drugs and alcohol and attend programs as his probation officer directs. He must also keep the peace toward his partner - and leave if she tells him to. He must pay a $100 surcharge for victims of crime by Nov. 17.

For the drug offence, the judge fined Flynn $750 plus a surcharge of $112.50 for victims of crime by Nov. 17.

For the incident involving the television, which he returned undamaged, Flynn was placed on probation for six months with conditions requiring him to keep the peace and be of good behaviour and to perform 30 hours of community service.

What becomes of the victim of crime surcharges? Is there ever a public accounting for the fund or wherever it goes to?
