SAINT JOHN - Jail only option, judge tells man

After five breaches of court undertakings in recent months, provincial court Judge Anne Jeffries told Wesley Willis Blanchard, 32, on Tuesday that she had no option but to jail him until his next scheduled appearance in mental health court on Aug. 28. Blanchard, who faces six separate charges at that time, asked to be sent to the psychiatric hospital at Campbellton, saying he was suicidal and would hurt himself if he went to jail. Jeffries imposed a 35-day sentence after the man pleaded guilty to breaching his probation by being intoxicated at the Salvation Army Hostel last Friday, saying it would help keep him out of trouble until his August court date.

Had single pill, gets $50 fine

SAINT JOHN - Since he had only a single Dilaudid pill on him when police executed a warrant targeting someone else at a residence he was visiting, John Millidge Owens, 49, of the Mallette Road, got a big break in exchange for his guilty plea to possession of the drug. Accepting a joint submission from the Crown and duty counsel, Judge Alfred Brien fined him $50.

Drunken driver fined $1,495

SAINT JOHN - David Christopher Green, 41, of Rosedale Crescent, who blew a pair of breathalyzer readings more than twice the legal limit, was fined $1,300, prohibited from driving for a year and ordered to pay a victim fine surcharge of $195. Green pleaded guilty to driving with an illegal blood alcohol reading. He was given until Nov. 26 to pay the fines. Green provided two blood samples of 210 milligrams of alcohol per 100 millitres of blood after being stopped by police in the uptown area on July 26, 2008. The legal limit is 80 mg.

Lacked licence, fisherman fined

SAINT JOHN - A fisherman who couldn't produce a valid 2009 fishing licence when asked by fisheries officers who boarded his boat, the Ocean Pearl, on June 14, has been fined $200 after entering a guilty plea to the charge. "It won't happen again," Thomas M. Mallock, 36, of St. Stephen, told provincial court Judge Alfred Brien.

Given suspended sentence, warning

SAINT JOHN - A 38-year-old woman who has consistently failed to follow the rules of mental health court was served notice by the judge who runs the court that by her actions she had "voluntarily removed" herself from that program. From this time on, provincial court Judge Alfed Brien told Karen Diane Steeves, 38, she will be treated the same as anyone else who comes to court. "Every time you do something, there will be a consequence," he warned her. However, she got a clean start. With the Crown offering no objections to her release, Steeves, who had been on remand since July 10, was given a suspended sentence on eight charges - seven of them for failing to comply with court orders. She had also pleaded guilty to a charge of communicating for the purposes of prostitution.
